Wills & Estates
At Randall Johns Law Office Professional Corporation, we understand that thinking about one’s own mortality and the necessary steps involved with drafting a valid Last Will and Testament isn’t necessarily the most comfortable area to address, but failure to do so could result in your assets being transferred to parties you wish not to benefit or could result in your estate being hit with significant and unnecessary tax consequences.
When a person passes away without a Last Will and Testament, they are said to have died “intestate”, which means that the person died without a valid document that deals with their assets and how they would like them distributed among their remaining family members and friends. In this instance, the person’s estate is distributed according to government legislation and, more specifically, the Succession Law Reform Act (the “SLRA”). The SLRA creates a fairly complex code that distributes an intestate’s estate according to the closest next-of-kin. As a result, if you wish to benefit a particular child, family member or friend and you pass away intestate, your wishes might not be followed. Furthermore, if you wish to benefit people with specific items from your estate, these wishes must be explicitly stated in your Last Will and Testament in order to be legally enforceable.
